Thank you for using SimmaSend. By using our site and service, you indicate that you accept these terms of use and agree to abide by them. If you do not agree, please do not use the site.

About us

SimmaSend is operated by James Ward. The service is accessible at simmasend.com and app.simmasend.com.

What SimmaSend does

SimmaSend is a web-based service that allows teachers to record voice, video, photo and text feedback for students. Feedback is transcribed and summarised by AI and delivered to students via a permanent QR code. Schools subscribe to SimmaSend and manage their own classes, students and teachers through an admin dashboard.

Accounts and access

• School administrators sign in via magic link (a secure, single-use link sent to their registered email address). No passwords are stored.
• Teachers are identified by a browser cookie set on first use. No teacher account or login is required. A school administrator may optionally store a teacher's email address for invitations and communications.
• Students do not have accounts. They access feedback by scanning a QR code, which opens a unique URL in their browser. A school administrator may optionally store a student's email address so that the student receives a notification when new feedback is available.

Acceptable use

You must not misuse SimmaSend by: knowingly introducing malicious software; attempting to gain unauthorised access to our systems; using the service for any unlawful purpose; uploading content that is abusive, offensive or inappropriate for a school environment; or attempting to access another user's data without authorisation.

By breaching this provision, you may commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities.

Intellectual property

We are the owner or licensee of all intellectual property rights in our site and the material published on it. These works are protected by copyright laws. You may not reproduce, distribute or commercially exploit any material from our site without our prior written consent.

Feedback content (audio recordings, text, photos, video) uploaded by teachers remains the intellectual property of the school. SimmaSend does not claim ownership of user-uploaded content.

AI-generated content

SimmaSend uses OpenAI's APIs to transcribe and summarise feedback. AI-generated summaries, titles and action points are provided as a convenience and may not always be perfectly accurate. Teachers and schools should review AI-generated content and not rely on it as a sole source of information.

Data and privacy

We process personal data in accordance with our Privacy Policy. By using SimmaSend, you consent to such processing and warrant that all data you provide is accurate.

Email notifications

SimmaSend can send email notifications to students when new feedback is available. This feature is opt-in at the school level — notifications are only sent where a school administrator has provided a student's email address. Notification emails do not contain any feedback content; they simply inform the student that new feedback is ready to view on their dashboard. Schools are responsible for ensuring they have an appropriate basis to share student email addresses with SimmaSend for this purpose.

Availability and changes

We aim to keep SimmaSend available at all times, but we do not guarantee uninterrupted access. We may update, modify or discontinue features at any time. Where possible, we will give reasonable advance notice of significant changes.

Our liability

The service is provided “as is” without any guarantees or warranties as to its accuracy or fitness for a particular purpose. To the extent permitted by law, we exclude liability for any indirect or consequential loss or damage, including loss of data, loss of business, or wasted time. This does not affect our liability for death or personal injury arising from negligence, nor any other liability that cannot be excluded under applicable law.

Our site may contain links to third-party websites. We have no control over those sites and accept no responsibility for their content.

Jurisdiction and applicable law

These terms are governed by and construed in accordance with the law of England and Wales. The English courts will have non-exclusive jurisdiction over any claim arising from your use of SimmaSend.

Amendments

We may revise these terms at any time by updating this page. Changes will not apply retrospectively. Please check this page periodically.
